In consideration of my desire to participate in, and being allowed to participate in, in any way, in Pine To Prairie Women’s Softball League, LLC athletic sports program and related events and activities, the undersigned acknowledges, appreciates and agrees for myself, my family, next of kin, my heirs, assigns, executors, personal representatives, and administrators, as follows:
I knowingly and voluntarily enter into this Waiver and Release of Liability as follows:
- Acknowledgement of Risks: I fully and knowingly acknowledge that softball is an inherently dangerous and hazardous athletic activity that can cause serious physical injury, psychological injury, pain, suffering, illness, disfigurement, temporary or permanent disability, paralysis, economic loss, property damage to my own property of others, concussions, and death. I further understand, agree and acknowledge that these injuries and outcomes may arise from my own or others’ negligence, travel to and from games, events and activities, conditions at the activity locations, or other causes; and
- Assumption of Risks and Waiver: Nonetheless, knowing the risks, I knowingly and freely assume all such risks, both known and unknown, foreseen or unforeseeable, even if arising from the negligence of the releasees or others by participating in the athletic program, and I assume full responsibility for my participation in the aforementioned athletic program, and related events and activities, and I hereby waive any and all rights, claims, causes of action, damages, judgments, costs or expenses, including attorney fees and other litigation costs, which may in any way arise from my participation in the athletic program, and/or related events and activities; and
- Release. I, for my myself, and on behalf of my family, next of kin, heirs, assigns, executors, personal representatives, and administrators, hereby release and forever discharge Pine To Prairie Women’s Softball League, LLC, its members, owners, managers, officers, agents, affiliates, staff, volunteers, employees, independent contractors, vendors, heirs, owners of the premises used to conduct the athletic program and/or events and activities, assigns and sponsors (collectively “Releasees”) from any physical injury, psychological injury, property damages or death that I may suffer as a result of my participation in the aforementioned athletic program, and/or related events and activities; and
- Indemnification. I further agree to indemnify, defend and hold harmless the Releasees from any and all claims, causes of actions, law suits, damages, judgments, costs or expenses, including attorney fees and other litigation costs which may in any way arise from my participation in the athletic program and/or related events and activities; and
- Duress. I further agree and acknowledge that I am under no pressure or duress to sign this Agreement and I have been given reasonable opportunity to review it before signing. I further acknowledge and agree that I have been offered to have my registration funds refunded if I chose not to agree to the terms herein, and that I am free to have my own legal counsel review this agreement. I sign this agreement as my own free act.
- Choice of Law. I agree that this agreement shall be governed for all purposes by the law of the State of Minnesota.
I hereby acknowledge that I have carefully read this Waiver and Release Agreement and fully understand that it is a release of liability. I expressly release and discharge Pine To Prairie Women’s Softball League, LLC, its members, owners, managers, officers, agents, affiliates, staff, volunteers, employees, independent contractors, vendors, heirs, owners of the premises used to conduct the athletic program and/or events and activities, assigns and sponsors (collectively “Releasees”) from any all claims or causes of action and I agree to voluntarily give up and waive any right that I otherwise may have to bring a legal action against Releasees for personal injury or property damage.
